The Nova Scotia Supreme Court has declared last summer’s ban on entering the woods to prevent forest fires was unreasonable and therefore unlawful. In issuing his decision, Justice Jamie S. Campbell agreed with the Canadian Constitution Foundation that the ban limited people’s mobility rights in direct contravention of section 6 of the Charter of Rights and Freedoms. Campbell says the Minister of the Department of Natural Resources failed to consider those rights, including how to minimize their impact. The justice also found the ban too broad in nature, failing to clearly define “woods” and which places were subject to the ban and the almost $29,000 fine.
